1. Who We Are

Pharma Afrique Ltd ("we", "us", "our") is a technology-enabled medicine delivery aggregator registered in Kenya. We operate the online platform at pharmaafrique.netlify.app. We are committed to protecting your personal information in accordance with the Kenya Data Protection Act 2019 and applicable regulations.

2. What Information We Collect

• Name and phone number — provided when you place an order or contact us via WhatsApp
• Delivery address — provided at checkout to enable delivery
• Prescription documents — uploaded voluntarily when ordering prescription medicines (images or PDFs)
• Order details — products ordered, quantities, and payment method
• Payment records — M-Pesa transaction references (we do not store card details)

3. How We Use Your Information

• To confirm and fulfil your medicine order
• To contact you via WhatsApp or phone regarding your order status
• To transmit your prescription to our licensed pharmacy partner for verification and dispensing
• To process and reconcile payments
• To improve our platform and customer experience

4. Prescription Documents

Prescription images or PDFs you upload are shared directly with our licensed pharmacy partners via WhatsApp for the sole purpose of verifying and dispensing your medication. They are not stored on our servers, not shared with third parties for marketing, and not retained beyond the fulfilment of your order.

5. Who We Share Your Data With

• Licensed pharmacy partners — to fulfil your order and verify prescriptions
• Delivery riders — name and delivery address only, to complete delivery
• No third-party marketing — we do not sell or share your personal data with advertisers or data brokers

6. Data Retention

Order records are retained for a minimum of 3 years for regulatory and tax compliance purposes under Kenyan law. You may request deletion of your personal data at any time by contacting us, subject to legal retention obligations.

7. Your Rights

Under the Kenya Data Protection Act 2019, you have the right to: access your personal data; correct inaccurate data; request deletion of your data; object to processing; and lodge a complaint with the Office of the Data Protection Commissioner (ODPC).

8. Security

We use industry-standard security measures including HTTPS encryption and security headers to protect your data in transit. Our platform is hosted on Netlify, which maintains SOC 2 Type II compliance.

1. About Pharma Afrique Ltd

Pharma Afrique Ltd is a technology and logistics platform that connects customers with licensed retail pharmacies in Nairobi. We are not a pharmacy and do not dispense medicines directly. All dispensing is performed by our licensed pharmacy partners who hold valid PPB Section 8 Certificates under the Pharmacy and Poisons Act Cap 244.

2. Eligibility

By placing an order, you confirm that you are at least 18 years of age, or are ordering on behalf of a person under medical supervision. You agree to provide accurate personal and delivery information.

3. Prescription Medicines (Rx)

• Prescription medicines will only be dispensed upon presentation of a valid prescription issued by a licensed healthcare practitioner
• By uploading a prescription, you confirm it is genuine, current, and issued in your name or for the person you are ordering for
• Submitting a fraudulent or altered prescription is an offence under Kenyan law
• We reserve the right to decline any order where the prescription cannot be verified

4. Ordering and Confirmation

An order placed on our platform is a request, not a confirmed purchase. We will contact you via WhatsApp or phone to confirm availability, verify prescriptions where applicable, and agree a delivery time before any payment is required.

5. Pricing

All prices are displayed in Kenya Shillings (Ksh) and are inclusive of applicable taxes. Prices are subject to change without notice. The price confirmed at the time of your WhatsApp order confirmation is the binding price.

6. Payment

• Payment is accepted via M-Pesa (Paybill 516600, Account 817800)
• Payment may be made before dispatch or at the point of delivery, once your order is confirmed
• We do not store or process card payment details

7. Delivery

• Delivery is available within Nairobi. Upcountry delivery is via courier and costs are confirmed at checkout
• A delivery fee of Ksh 300 applies to orders below Ksh 4,000. Orders of Ksh 4,000 and above receive free delivery within Nairobi
• Estimated delivery times are provided at order confirmation but are not guaranteed
• Risk of loss passes to you upon delivery to the address provided

8. Returns and Refunds

Due to the nature of pharmaceutical products, we do not accept returns of dispensed medicines unless: (a) the wrong product was delivered; or (b) the product was damaged or defective at the time of delivery. Claims must be made within 24 hours of delivery. Refunds are processed within 7 working days via M-Pesa.

9. Limitation of Liability

Pharma Afrique Ltd acts solely as a technology and logistics intermediary. We are not liable for: dispensing errors by pharmacy partners; adverse reactions to medicines; delays caused by third-party courier services; or any loss arising from the use of medicines dispensed by our pharmacy partners. Our aggregate liability to you for any claim shall not exceed the value of the order in question.

10. Intellectual Property

All content on this platform, including product descriptions, images, and design, is the property of Pharma Afrique Ltd or its licensors and may not be reproduced without written permission.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
